GENERAL TERMS AND CONDITIONS OF SALE OF LA COUR DES SAVEURS S.A.R.L

A. GENERAL CLAUSES
These general terms and conditions of sale of La Cour des Saveurs SARL are systematically offered for consultation and are accessible to each buyer to enable them to place an order.

B. Ordering and Fulfilment

Orders placed with La Cour des Saveurs SARL bind the Customer from the moment they are validated by pressing the "Send the order and print" button on the order form.

Since the rendering of images on monitors is by nature different from offset printing, La Cour des Saveurs SARL is not responsible for minor variations in colour or appearance of the products shipped. In particular, the fact that the customer manually adjusts their monitor does not allow La Cour des Saveurs SARL to guarantee that the colours of the books (for example) shipped are exactly those that the Customer sees on their screen at the time of ordering.

The customer also undertakes to respect copyright concerning the digital images of reproductions of book covers, paintings (for example) visible on the site. The copying of these images, for commercial use, reproduction on another medium, or modification of the original work is therefore strictly prohibited and may under no circumstances engage the liability of La Cour des Saveurs SARL

Consequently, any validated order implies the buyer's full and unreserved acceptance of these general terms and conditions of sale, which the Customer acknowledges having consulted and declares to accept. No special condition may prevail; any contrary condition laid down by the buyer shall therefore be unenforceable against La Cour des Saveurs SARL unless expressly accepted.

C. Method and Time of Shipping

Orders placed from Monday to Thursday are delivered within 8 days except (for coats of arms 30 days on average) to a Colissimo relay point

(Orders placed on Saturday and Sunday are grouped together on the following Monday

Products are offered subject to available stock.

After payment, the order is prepared by one or more senders. To this period is added the delivery time of the order by the carrier. Orders are shipped by the Carrier to the recipient's address indicated by the Customer.

Delivery will be carried out by an approved carrier with acknowledgement of receipt (signature upon receipt of the parcel) For the guarantees to apply (refund in the event of breakage), you must imperatively check the parcel upon delivery.(proof of tracked parcel).

In the event that, for reasons directly dependent on the operation of the Carrier's services, the delivery time is increased, the liability of La Cour des Saveurs SARL cannot be sought. No compensation, indemnity or damages may be claimed by the Customer on this basis.

D. Validity Period of the Offer
Offer valid until stocks are exhausted.

E. Prices

The prices mentioned on the site "www.la-cour-des-saveurs.com" are valid at the time of their consultation by the Customer.

La Cour des Saveurs SARL reserves the right to modify its prices without delay, it being understood that the prices invoiced are those in force at the time of the order.

Shipping costs are borne by the Customer, as well as VAT (for a customer domiciled in the EEC) and any other applicable taxes. Shipping or postage costs and VAT are totalled in the final price shown on the La Cour des Saveurs SARL order form. If you would like an invoice, please specify this in the "comment" section

F. Online Payment:
Payment is made by bank transfer (request this by sending an email) or with Visa/Eurocard Master Card and paypal. Payment is collected upon ordering.

All online payments will be secured by the BANK. Only the latter will have knowledge of your banking details (card number and expiry date).

Delivery will be carried out by an approved carrier with acknowledgement of receipt (signature upon receipt of the parcel) For the guarantees to apply (refund in the event of breakage or loss), you must imperatively check the parcel upon delivery.(proof of tracked parcel).

La Cour des Saveurs SARL will cancel the order (cancellation of the transaction and direct refund by bank card) if it is unable to honour it for any reason whatsoever, and will inform the Customer.

G. Transport
Products travel at the buyer's own risk; it is up to the latter to check the contents of the parcel at the time of delivery and to formulate any reservations to the carrier by registered letter or extra-judicial document within three days following receipt of the parcel. Customs duties or additional taxes related to border crossings are payable by the buyer and are not included in the total price (transport included).

H. Right of Withdrawal
The Buyer has a legal period of fourteen (14) clear days from receipt of the Products to exercise their right of withdrawal.
Withdrawal must be notified by registered letter with acknowledgement of receipt by completing the "withdrawal letter template", and sent to La Cour des Saveurs SARL within this period - the postmark serving as proof.
In this case, La Cour des Saveurs SARL undertakes to exchange the Products or, if the Buyer so wishes, to reimburse the price of the Products as well as the cost of shipping them, within fourteen (14) days following receipt of the returned goods.
Return costs remain borne by the Buyer. The risk associated with the return of the product is borne by the Buyer.
The right of withdrawal may only be exercised for complete products, in their original condition and packaging and without having been opened (vacuum seal still present in the jars) with the provision of a copy of the purchase invoice.
Returned products that are incomplete, damaged, soiled, spoiled or whose packaging has been opened will not be accepted.
After this fourteen (14) day period, no product may be returned for exchange or refund.

J. Liability/Claims

La Cour des Saveurs SARL is solely responsible for the content of its offer and the commitments it makes, in particular those relating to delivery times.

La Cour des Saveurs SARL is solely authorised to handle claims or disputes relating to any product order, its shipment or its payment. If the dispute concerns payment operations, the banking institution or the third party responsible for the payment system may be consulted.3. The Customer is solely and fully responsible for the content, form, messages and all other data entered by them when personalising the order. The liability of La Cour des Saveurs SARL cannot be engaged in the event of an input error, and the Customer should in all cases consider the personalised card to be valid.

The texts entered by the Customer are deemed free of all reproduction, representation and all other intellectual property rights. The liability of La Cour des Saveurs SARL may under no circumstances be sought in the event of a difficulty, the Customer guaranteeing it against all recourse in this respect.

K. Proof of Transactions

The data recorded by La Cour des Saveurs SARL constitute proof of all commercial transactions carried out by La Cour des Saveurs SARL and its Customers.

The data recorded by the payment system used and chosen by the Customer (national bank card, "Visa" or "Eurocard/Mastercard" or paypal payment) constitute proof of all financial transactions carried out by La Cour des Saveurs SARL, its Customers and the said institution.

L. Right of Access to Files

In accordance with the Data Processing and Freedoms law of 6 January 1978, the Customer has a right of access and rectification relating to the data concerning them as well as a right of opposition.

M. Jurisdiction - Disputes The courts of Paris shall have sole jurisdiction in the event of a dispute of any nature or contestation relating to the formation or performance of the order arising with our Customers. This clause applies even in the case of summary proceedings, incidental claims or multiple defendants and regardless of the method and terms of payment.
